Add a user parameter to the copyright rules for accessibility
We work closely with our Student Accessibility Support office with particular regard to our students with print disabilities. Students let that office know that they opt-in to disclosure of their name to the library, so when it comes to digital access rights, they have elevated permissions. This impacts any in-copyright materials that are digitized solely for accessibility as well as items we have in controlled digital lending.
To complement what we have done with regard to digitized materials in our catalog, we would also like to add a parameter to the copyright rules so when these patrons make chapter or article requests, they can also bypass the normal United States copyright rules as allowed under the Chafee Amendment (17 U.S. Code § 121) since they have a documented accessibility need. Since resource sharing staff do not have an easy mechanism to know which students have print disabilities, without such parameters in place these students are denied scans to which they are legally entitled and which they need for their education.
